These terms govern courier delivery, customs clearance, freight forwarding, warehousing, and vehicle importation services provided by Ricnel Logistics Ltd. Specific services for a given shipment are set out in our quotation or order confirmation.
Quotations are valid for the period stated on the quotation, or 14 days if no period is stated. Quotations are based on the information you provide and on statutory rates in force at the time of issue. Quotations exclude any statutory duty, levy, or tax change that comes into force after the quotation was issued; where such a change applies to your shipment, the revised statutory amount applies and will be communicated to you before payment is due.
You are responsible for providing accurate, complete documentation and declarations for your cargo, including correct descriptions and values. You agree to pay all agreed fees, statutory duties, and disbursements within the timeframe stated on our invoice. Delays or additional costs caused by inaccurate or incomplete information provided by you are your responsibility.
Disbursements we pay on your behalf, including port storage, shipping line charges, and demurrage, are passed through to you at cost, supported by receipts. These are separate from our agency fee.
Where charges owed to us in connection with a shipment remain unpaid, we reserve a lien over the goods in our possession or control until those charges are settled. The precise scope and enforcement of this lien is a draft clause pending legal review.
Demurrage, port storage, and similar charges that arise from delays in clearance or collection are payable by you, whether the delay is caused by documentation issues, customs verification, or a failure to collect goods promptly after release.
Our liability for loss or damage arising from our services is intended to be limited as set out in this clause, save for loss caused by our gross negligence or wilful misconduct. The specific limitation figures and exclusions in this clause are a draft pending legal review and must not be relied upon until finalised.
These terms are governed by the laws of Kenya, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of Kenya.
